Any person who, after the effective date of this division [December 10, 1998], seeks
to develop land by applying for the issuance of a building permit for any residential
structure, as defined in section 42-98 herein, shall be required to pay a recreation impact fee prior to the issuance of
the building permit or any other development permit for the construction of any structure
to be used for a residential use, except as provided herein, no building permit shall
be issued unless and until the recreation impact fee hereby required has been paid.
