§ 10-176. Prohibited locations.

(a)

Notwithstanding any other section of this article or any section of this Code, no person shall cause or permit the establishment or substantial enlargement of an adult bookstore, adult motion picture theater, massage establishment or an adult dancing establishment within 1,000 feet of another such business; within 1,000 feet of any preexisting religious institution or school; within 1,000 feet of an area zoned for a school; within 1,000 feet of an area zoned for residential use within the city; within 500 feet of either side of the right-of-way of Highway 50 and East Plant Street (that part of S.R. 438 east of Dillard Street in the city); and within 500 feet of any preexisting commercial establishment that in any manner sells or dispenses alcohol for on-premises consumption.

(b)

The distance requirements of subsection (a) of this section are independent of and do not supersede the distance requirements for alcoholic beverage establishments contained in section 6-3.
