§ 71-124. Indemnification.

A grantee shall indemnify, save harmless and defend the city, its elected officials, officers, employees, and agents, against any and all claims of whatever nature resulting from the installation of a grantee's facilities and equipment, or the use of any easement or right-of-way. The indemnification shall include any and all costs, expenses and reasonable attorney's fees. In the event it becomes necessary for the city to seek administrative or judicial enforcement of any franchise granted under this chapter against a grantee, the city shall, upon prevailing, be entitled to its reasonable attorneys' fees and costs, including any appellate actions.
