Notwithstanding anything contained in this chapter, neither the grantee nor the city
shall be liable for delay in performance of, failure to perform, in whole or in part,
its respective obligations pursuant to this chapter due to strike, war or act of war
(whether an actual declaration of war is made or not), insurrection, riot, civil disturbance,
act of public enemy or other events beyond its control. The grantee shall take all
steps reasonable and necessary to avoid the consequence of a force majeure as defined
above.
