§ 38-215. Severability.

  • If any section, subsection, sentence, clause, phrase or portion of this article is for any reason held to be invalid or constitutional by the final decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this article, and to this end the provisions of this article are declared severable. The city commission declares that it would have adopted this article and each section, subsection, sentence, clause, phrase, or portion thereof, despite the fact that any one or more section, subsection, sentence, clause, phrase, or portion would be declared invalid or unconstitutional.
