§ 4. Damage claims.

  • The district shall indemnify, keep, and hold the city, its officers, agents, and employees, free and harmless from liability on account of death, injury or damage to persons or property growing out of the construction, maintenance, repair or operation of its property, or due to the negligence of the district, its agents or employees, in operating its property, and in the event that suit shall be brought against the city, either independently or jointly with the district, on account thereof, the district upon notice to it by the city, shall defend the city in any suit, at the cost of the district; and in the event of a final judgment being obtained against the city, either independently or jointly with the district, the district shall pay such judgment with all costs, and shall hold the city harmless therefrom.
